Colonel Francis Barber, a native of Princeton and an officer in the 3rd New Jersey Regiment, suspected that Gifford wanted to go to the British and advised Washington on December 11 of his concerns.41 Barber said when Gifford came out of New York, he was exchanged. Gifford then met up with the brigade on its way from West Point to Pompton about December 1. Gifford informed him that he was not exchanged but was soon expected to be and was out on a parole. His parole was until December 14 and then he was required to return to Long Island.

Washington advised Barber, knowing that he needed more proof before he could do anything and told him:

If there are good reasons for suspecting Capt[ain] Gifford’s fidelity, I would by no means give him a discharge from the army, because he might then go off to the enemy, and we should not have it in our power to treat him as a deserter should he fall into our hands again. I would at any rate bring him to a trial on his arrest; something may, in the course of it, turn up, which may give sufficient grounds for securing him afterwards, if the sentence of the court should not find him guilty in a military point of light. Should he be cashiered, and then go off, the enemy will not have much to boast of, from the acquisition of such a character.42
